PLACEMENT OF POLLUTANTS INTO DISTRICT FACILITIES <br /> 1 . All mechanical devices , connecting lines , or natural ditches , <br /> electric pumping facilites or all other devices of any kind, <br /> which can cause or facilitate the transfer of pollutants <br /> from any location, pond , or other like facility into District <br /> pipelines and other District facilities , is prohibited . <br /> 2 . Although the District prohibits the intentional placement of <br /> waste into its facilities , inadvertent spilling into District <br /> facilities will be tolerated so long as the entire amount of <br /> said spilling is contained upon the property of that landowner . <br /> Contamination of District facilities and other streams and <br /> rivers is , in and of itself , a violation of the law, as well <br /> as a legal nuisance to others which must be controlled by the <br /> landowners or be prosecuted as stated in the District Rules <br /> and Regulations . <br /> 3 . However, in all cases where the staff and a meeting with the <br /> General Manager has not resolved the problem with the land- <br /> owner, the matter shall be set for a hearing at a regular Board <br /> meeting and the violator shall be given timely notice of said <br /> hearing and the opportunity to appear before the Board either <br /> in person, by representation, or both, and will be given the <br /> opportunity to be heard on the matter pertaining to the <br /> violation. <br /> 4 . After determination that a violation has occurred and that <br /> action should be taken, the District shall pursue all appro- <br /> priate actions and legal remedies to compel the landowner to <br /> cease and desist the prohibited practices, up to and including <br /> disconnection of the mechanical devices causing the violation <br /> and the withholding of water delivery, if necessary, until said <br /> devices are disconnected , inspected and approved by a District <br /> representative . <br /> 10/28/82 <br />
