PHS/ HD has prepared the following <br /> comments for your consideration. <br /> On December 26, 1997 PHS/EHD reviewed and approved the "Soil Contamination Containment Action <br /> Plan"(enclosed) which San Joaquin Public Works (Public Works) had prep az d. In light of the results and <br /> recommendations which are presented within the Soil Sampling Report,PHS EHD must rescind approval of <br /> the Soil Contamination Containment Action Plan. <br /> Please note that until such time as the contamination is properly characterize I it should be considered as <br /> suspected hazardous waste and as such falls under the regulatory authority of the Department of Toxic <br /> Substance Control (DTSC) and Central Valley Regional Water Quality Controi Board (CVRWQCB). The <br /> training and authorization necessary for employees or contractors working o hazardous waste sites are <br /> regulated by the Contractor's License Board and the Occupational Safety and Health Administration. <br /> PHS/EHD does not have regulatory authority to work on hazardous waste sits unless agreements between <br /> the DTSC,the CVRWQCB and a cooperative responsible party have been made with our agency. PHS/EHD <br /> has discussed the site with the CVRWQCB and obtained verbal authorization to work on the site as an <br /> environmental assessment,when it was believed to have been contaminated by petroleum hydrocarbons. <br /> PHS/EHD does not have regulatory authority to provide directives on this site. PHS/EHD has already referred <br /> the site to the CVRWQCB.
