LAWSON ENTERPRISES, LLC DBA WILDROSE VINEYARDS <br /> SAN JOAQUIN COUNTY <br /> or discuss with staff any problems it was encountering in meeting the prescribed deadlines, but <br /> failed to do so. <br /> By failing to submit the required reports, the Discharger realized an economic benefit by delaying <br /> the expenditure of funds necessary to fully assess the impacts on water quality from this particular <br /> discharge of waste, and to provide the required information. There may be other matters that <br /> justice requires. <br /> 22. The Discharger's 30 November 2001 response following receipt of the Complaint for <br /> Administrative Civil Liability issued by the Executive Officer indicates the Discharger's <br /> willingness to comply with the WDRs and its monitoring requirements. The Board determines in <br /> this Order to assess an administrative civil liability of$25,000, and requires the Discharger,to pay <br /> $15,000 to the State Water Resources Control Board Cleanup and Abatement Account within <br /> 30 days of the date of this Order and suspends the remaining$10,000 contingent upon submission <br /> of complete reports describing the following tasks to the satisfaction of the Executive Officer by <br /> no later than 8 April 2002. If the Discharger fails to complete the tasks by 8 April 2002, the <br /> Discharger shall pay the remaining $10,000 to the State Water Resources Control Board Cleanup <br /> and Abatement Account within 30 days of the date of the notice by the Executive Officer. The <br /> Discharger shall submit the following reports and plans by 8 April 2002: <br /> a. A report describing the installation of a flow meter to measure winery wastewater flow to <br /> determine compliance with Discharge Specification No. B.1 as described in WDRs Provision <br /> F.2.a. The report shall clearly show that all winery wastewater is being metered. Use of a <br /> pump run time meter is not acceptable to satisfy this requirement. <br /> b. Either a groundwater monitoring well installation workplan as described in WDRs Provision <br /> F.2.b or, if use of wells owned by other parties is proposed, then submit a workplan that <br /> includes access agreements,well construction details, groundwater data collected to date, <br /> sample collection and handling procedures, and clearly show that the existing wells are <br /> adequate to monitor the land application area. The report shall be signed by a California <br /> licensed engineer or geologist. <br /> c. An Operation and Wastewater Management Plan (0&WM Plan) as described in WDRs <br /> Provision F.2.c. <br /> d. If the California licensed engineer or geologist's report described in Finding 22.b determines <br /> that groundwater monitoring well installation is necessary,then submit a groundwater well <br /> installation report as described in WDRs Provision F.2.d. If installation of additional wells is <br /> not required,this report requirement is waived. <br /> If the Discharger fails to complete the tasks described above by 8 April 2002, then the remaining <br /> $10,000 will become due within 30 days of notification by the Executive Officer. <br /> 23. Staff costs associated with processing this Order are approximately eight thousand dollars <br /> ($8,000). <br />
