• 0 <br /> ITEM: 15 <br /> SUBJECT: R. Lawson Enterprises, LLC dba WildRose Vineyards, San Joaquin <br /> County— Consideration of Administrative Civil Liability Order <br /> DISCUSSION: R. Lawson Enterprises, LLC dba WildRose Vineyards (Discharger) <br /> operates a winery and related wastewater treatment and disposal system <br /> at 8751 E. Highway 12,Victor in San Joaquin County. The Discharger's <br /> wastewater system is regulated by Waste Discharge Requirements <br /> (WDRs) Order No. 5-00-182. The Discharger was required to make <br /> improvements to the wastewater treatment system in accordance with the <br /> provisions of the WDRs. The Discharger has failed to complete many of <br /> the improvements, failed to submit technical reports, and failed to submit <br /> the monitoring reports required pursuant to California Water Code <br /> (CWC) Section 13267. The Discharger was notified of the <br /> noncompliance verbally and in writing. <br /> A site inspection performed on 26 July 2001 revealed numerous <br /> violations of the WDRs' wastewater application requirements and the <br /> failure to construct required improvements to the wastewater treatment <br /> system. The Discharger has never complied with the monitoring and <br /> reporting program. By failing to improve the wastewater system, submit <br /> the required technical reports, and submit the monitoring reports,the <br /> Discharger realized an economic benefit by delaying the expenditure of <br /> funds necessary to fully assess and/or mitigate the impacts on water <br /> quality from this particular discharge of waste. <br /> RECOMMENDATION: Adopt the proposed Administrative Civil Liability Order in the amount of <br /> $25,000. <br /> Mgmt.Review <br /> Legal Review -r L_11n <br />
