Cotulla: <br /> Lustre-Cal has reviewed your comments dated December 14, 1992 . We <br /> have also given a copy to a representative of Ackel Properties. <br /> In your letter you requested that Lustre-Cal submit a work plan and <br /> pay minimum fees for PHS/EHD' s regulatory oversight by February 15, <br /> 1993. We will not be able to meet that request for reasons listed <br /> below but soon hope to submit the requested work plan. <br /> Lustre-Cal has asked the California Environmental Protection Agency <br /> Department of Toxics Substances Control (CAL-EPA DTSC) to transfer <br /> the oversight for closure of the concrete tank to San Joaquin <br /> County Public Health Services Environmental Health Division <br /> (PHS/EHD) . From telephone conversations with Stephen Posner , a <br /> member of Nancy Lancaster ' s staff , it appears that the DTSC is in <br /> agreement with that request. However , Lustre-Cal has not yet <br /> received the decision to transfer the oversight responsibilities. <br /> Lustre-Cal and Ackel Properties are working together to agree upon <br /> cost sharing for this project.
