ARCO Products Company, <br /> a division of AtianticRichfieldCompany FACILITY NO. dd� <br /> AMENDMENT TO LESSEE PMPA FRANCHISE AGREEMENT/DEALER/PREMISES LEASE <br /> OPERATION OF UNDERGROUND STORAGE TANKS <br /> This Amendment, dated LILIxu e7 19 is attached to, incorporated <br /> in and made a part of the Lessee PMPA FranOise Agreement/Dealer/Premises Lease ("PMPA <br /> Agreement"), in effect as of the date of this Amendment or, If applicable, to become effective <br /> concurrently with this Amendment, between Atlantic Richfield Company, a DelaWare Corporation, <br /> through its division ARCO Products Company, ("Franchisor" and L - , \. ' , A,' , <br /> ("Franchisee"), covering premises located at C71t, , ,,�,;,,1 � �4 <br /> -7 <br /> In return for good and valuable consideration, each party's receipt of which is hereby acknowledged, <br /> the parties agree as follows: <br /> 1 . The parties have entered into this Amendment in accordance with legal requirements imposed <br /> on Franchisor and Franchisee concerning operation of the underground storage tanks at the above- <br /> referenced location. <br /> 2. Franchisor has provided Franchisee a copy of the following listed documents, a copy of which <br /> is attached and initialed by Franchisee: <br /> MONITOR & RESPONSE PLAN <br /> ,l /Attachments <br /> 3. Where Franchisor has provided Franchisee with a copy of the permit to operate the <br /> underground storage tanks, Franchisee has read and understood it's responsibilities as operator <br /> under the permit and agrees to comply with each of the provisions of the permit. Irrespective of <br /> whether Franchisee has received and reviewed a copy of the underground storage tank operating <br /> permit, Franchisee hereby expressly agrees to do the following: <br /> (a) monitor the underground tanks as required by law; <br /> (b) maintain all required records and make such records available to the federal, state <br /> and local government agencies and to Franchisor at all reasonable times; <br /> (c) follow all reporting procedures as required by law; <br /> (d) mail, when submitted, to Franchisor, at the address specified in paragraph 1 of the <br /> PMPA Franchise Agreement/Dealer/Premises Lease, a copy of all reports submitted to government <br /> agencies; <br /> (e) follow all operating procedures specified by Franchisor; <br /> ( f) immediately report to Franchisor all suspected or confirmed releases from the tanks <br /> and connected piping system, unusual operating conditions, release detection signals and <br /> environmental conditions suggesting a release may have occurred, and any spills and overfills that <br /> are not contained and cleaned up; <br />
