Approximately a year and a halt ago
or more, some correspondence took place between a firm of attorneys in Los
Angeles, apparently representing the Port of Stockton, and the undersigned
concerning the obligations of the Trustee under a lease, which he did not
assume, to expend monies, which he did not have in the bankrupt' s estate, for
maintenance, testing or removal of the underground tanks on the premises
leased by the Debtor prior to its adjudication in bankruptcy. At that time, I
advised a Mr. Steven P. McDonald of the law firm of Dorado, Barnhorst &
Bonar, that I did not concur v,ith his analysis of the liability situation nor
that of the Trustee' s legal obligations. On July 11 , 1988, Mr. Ulrich, as
Trustee, filed his First and Final Report and Account, and pursuant to an
Order Settling the Trustee' s First and Final Report and Account signed by the
Honorable J. W. Hedrick, Jr. , Bankruptcy Judge, on December 12, 1988, all
funds in the estate were paid to the priority tax claimant, the United States
Internal Revenue Service.
Trusting that this .rill give you the information which will assist you at
your proposed meeting with the various interested parties, I remain,
Sincerely yours,
BLEWETT/& GARRFTSON
Rofla L. Garrets Jr.
RLG:pp
cc: Jack A. Ulrich, Trustee
