May 24 , 1988 <br /> Page -5- <br /> Section 25299 . 01 provides as follows : <br /> "§25299 . 01 . Injunctions ; restraining orders or other <br /> orders <br /> When any person has engaged in, is engaged in, <br /> or is about to engage in any acts or practices which <br /> violate this chapter, or any rule, regulation, permit, <br /> standard, requirement , or order issued, adopted, or <br /> executed pursuant to this chapter, the city attorney <br /> of the city in which the acts or practices occur, <br /> occurred, or will occur, the district attorney of <br /> the county is [sic] which the acts or practices occur, <br /> occurred, or will occur, or the Attorney General <br /> may apply to the superior court for any order enjoining <br /> these acts or practices , or for an order directing <br /> compliance. The court may grant" a permanent or <br /> temporary injunction, restraining order , or other <br /> order . " <br /> It is , therefore, my conclusion that at least from <br /> a time preceding July 17 , 1987 , when possession of the <br /> real property was delivered to the Port of Stockton, the <br /> Port of Stockton became the owner of the four tanks , subject <br /> to the provisions of the Underground Storage of Hazardous <br /> Substances , including „but not limited to (1) the transfer <br /> of ownership regarding the permit, arid ` (2) the abandonment, <br /> closing or temporary ceasing of operation.
