At that meeting the CSLB
agreed to render an opinion whether certain types of boring
operations were exempt from licensure.
First of all, let me explain and describe the different
types of boring operations other than oil, gas, and water-
well drilling the Board deals with.
Vapor Probes
Two types come to mind. one is the kind inserted at
strategic locations in the direct back fill area of buried
petroleum storage tank that holds either gasoline, diesel,
kerosene, or automotive waste oil . This operation entails
driving a one or two-inch bore hole with a hand-held Jack-
hammer type rig to depths up to about twenty feet . A
slotted pvc pipe with an attached sensing device is then
lowered into the bore hole. The sensing devices are then
connected electronically to a vacuum pump above ground which
in turn extracts sample vapor fumes from the slotted pipe
location around the tank. The density of the vapor fumes is
recorded to verify the tank is not leaking. Since both the
slotted pipe and connected sensors remain in the ground,
this operation requires a contractors licensed within the
meaning of section 7026 (Contractor Defined) of the business
and Professions Code.
The slotted pipe and connected circuitry falls into the
category of 11 . . .construct, alter, repair, add to, subtract
from, improve. . . ° of that "Contractor Defined" section.
