2 OIL, ASSOCIATED PIPELINE COMPANY, GETTY OIL, CHEVRON U.S.A. , <br /> Respondents : <br /> 3 <br /> 4 <br /> WHEREAS it is alleged by the verified petition of JOE Y. <br /> , <br /> 5 SAUNDERS AND CHARLOTTE MADURA that they are each owners of <br /> residential property in the subdivision known as TENNIS VISTA in <br /> 6 <br /> the City of Tracy. County of San Joaquin, State of California, <br /> 7 <br /> 8 and they purchased their property unaware of TENNIS VISTA being a <br /> former oil storage reservoir . <br /> 9 <br /> 10 Excavation was begun on an undeveloped parcel of land in <br /> the subdivision, and mounds of contaminated soil were left lying <br /> 11 <br /> abandoned upon the surface of the undeveloped land, along with <br /> 12 <br /> pipe, concrete, and equipment . Said conditions have left this <br /> 13 <br /> undeveloped land a continuing nuisance, spreading contaminated <br /> 14 <br /> hydrocarbons to the community generally and specifically <br /> 15 <br /> impairing the quiet enjoyment and use of the petitioners ' <br /> 16 <br /> property , and decreasing their property values , as well as <br /> 17 <br /> endangering their health. <br /> 18 <br /> WHEREAS it appears that petitioner is a party <br /> 19 <br /> beneficially interested in this proceeding; <br /> 20 <br /> WHEREAS , it appears from the verified petition that <br /> 21 <br /> petitioners have no plain, speedy, and adequate remedy in the <br /> 22 <br /> ordinary course of law and that an alternative writ of mandate <br /> 23 <br /> should issue . <br /> 24 <br /> NOW, THEREFORE, you are commanded on or before Feb.4 , <br /> 25 <br /> 19 88 to remove or cause the removal of the mounds of <br /> 26 <br /> contaminated soil which were excavated and then left abandoned <br /> 27 <br /> 28 and to also remove or cause the removal of the concrete , pipe, <br /> and equipment lying upon the undeveloped property at the corner <br /> 2 <br />
