A petitioner <br /> 4 <br /> has a sufficient beneficial interest in issuance of a writ of <br /> 5 <br /> mandate by possession of some special interest to be subserved or <br /> 6 some particular right to be preserved or protected independent <br /> 7 from that held in common with the public at large. A private <br /> 8 citizen may apply a 1 for a writ of mandate "where there is not a <br /> 9 <br /> plan , speedy , and adequate remedy" at law and he is a "party <br /> 10 <br /> beneficially interested .
