• <br /> claims program. <br /> These liability stipulations extend to-all phases of Chevron's work <br /> at the site, including construction, operation, and removal of the <br /> facilities. <br /> 2. The sites for various activities are indicated with the <br /> following letters on the map in Attachment 1. <br /> A. Adding equipment to the existing bioventing facility. <br /> B. Planting trees in Alden Park. <br /> C. Excavating one oil seep. <br /> D. Sampling from existing groundwater monitoring wells. <br /> Attachments 2 and 3 show the detail of the equipment that will be <br /> added to the existing bioventing facility. The additional <br /> equipment includes a submersible liquids pump, a compressed air <br /> system to operate the pump, and an oil/water separation tank. The <br /> process is described in detail in the referenced Work Plan. <br /> 3 . After work is completed and equipment is removed from the site, <br /> Chevron will restore any areas that were affected by construction <br /> or operations to their original condition. This includes resodding <br /> affected park areas. The restoration will be completed to the <br /> City's satisfaction. <br /> 4 . Chevron Pipe Line Company shall comply with all laws, <br /> regulations, and standards applicable to the work. <br /> 5. Construction will begin in July, 1989. The process will begin <br /> operating in September, 1989 . Design data will be collected while <br /> the process operates. Then a full-scale system will be designed <br /> and installed under a separate operating agreement in 1990. <br /> 6. Chevron Pipe Line Company will continue to exercise best <br /> efforts in cleaning up the park, working with the City of Tracy and <br /> appropriate regulatory agencies. <br /> 7 . Chevron Pipe Line Company will perform work and operate in only <br /> those areas shown on Attachment 1. Any work that needs to be done <br /> outside of those areas will proceed only after appropriate <br /> encroachment permits are obtained from the City. <br /> 8 . Chevron Pipe Line Company will correct vandalism to its <br /> facilities in as timely a manner as possible. <br /> 9 . As addressed in the referenced Work Plan, Chevron will exercise <br /> best efforts to protect the use of the park by the public. The <br /> bioventing mitigation facility occupies a small area north of the <br /> park. Other activities in the park, specifically tree planting and <br /> work on oil seeps, will proceed as expediently as possible. All <br />
