SAN ,dDAQ U I N Environmental Health Department <br /> C01-1 N T <br /> Large Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> TOYOTA TOWN 2150 E HAMMER LN, STOCKTON May 11, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 115 CCR 66262.42(a)(b)(d)Failed to comply with uniform hazardous waste manifest exception requirements. <br /> OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests <br /> (UHWM)007111953SKS with ship date 09-10-19. <br /> REGULATION: <br /> (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator <br /> of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the <br /> transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. <br /> (b)A generator shall submit an Exception Report to the Department if the generator has not received a copy of the <br /> manifest with the handwritten signature of the owner or operator of the designated facility within 45 days of the date <br /> the waste was accepted by the initial transporter.The Exception Report shall include: <br /> (1)a legible copy of the manifest for which the generator does not have confirmation of delivery; <br /> (2)a cover letter signed by the generator or the generator's authorized representative explaining the efforts taken to <br /> locate the hazardous waste and the results of those efforts. <br /> (d)Generators shall submit the exception report to the department at: DTSC Report Repository, Generator <br /> Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 <br /> CORRECTIVE ACTION: Locate a copy of the destination facility signed manifest and send a copy to the San <br /> Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be <br /> found then prepare an exception report for each missing manifest as required by Title 22 California Code of <br /> Regulations section 66262.42. The exception report shall include a legible copy of the manifest for which the <br /> generator does not have confirmation of delivery and a cover letter signed by the generator or the generator's <br /> authorized representative explaining the efforts taken to locate the hazardous waste and the results of those efforts. <br /> DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA <br /> 95812-0806. Send a copy of the exception report to DTSC and the EHD. <br /> This is a repeat violation, Class II. <br /> 118 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Copies of consolidated manifest receipts from 05/11/17-12/31/17, 04/30/18, 10/08/18, 10/12/18, <br /> 10/15/18, 10/19/18, 10/22/18, 11/02/18, and 01-02-19 for hazardous wastes including used oil, used antifreeze, and <br /> parts washer solution were not found on site during the inspection <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from 05/11/17-12/31/17, <br /> 04/30/18, 10/08/18, 10/15/18, 10/19/18, 10/22/18, 11/02/18, and 01-02-19 and maintain them on site.
