Operator states filters have <br /> been draining on the cart for up to one month. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately transfer used paper oil filters to appropriate storage container and manage <br /> the waste according to Title 22 California Code of Regulations for hazardous waste. Submit a statement and <br /> supporting documentation to the San Joaquin County Environmental Health Department describing the storage and <br /> final disposition of the cleaned up waste. <br /> This is a minor violation. <br /> 406 CCR 66261.7 Contaminated container not marked with date emptied or managed within one year of being emptied. <br /> OBSERVATION: The following were observed outdoors adjacent to hazardous waste storage area: <br /> -One empty 55-gallon container with corrosive solvent label observed with no empty date. Operator states that the <br /> empty drum has been on-site for up to four years. <br /> REGULATION GUIDANCE: Empty containers which previously held a hazardous material, including hazardous <br /> waste must be managed per Title 22 California Code of Regulations(CCR)section 66261.7. Refer to this section <br /> and California Department of Toxic Substances Control guidance for more information. <br /> CORRECTIVE ACTION: Immediately label all empty containers with the date they were emptied and manage <br /> within one year of that date. Manage the container per Title 22 CCR section 66261.7.
