KLEINFELDER <br /> File No. 20-3978-01.1`02 <br /> November 12, 1996 <br /> All information gathered during the study by Kleinfelder is considered confidential and will be <br /> released only upon written authorization from the client or as required by law. California law <br /> requires a person to inform the state if a situation is encountered that can be considered an <br /> immediate endangerment to the public's heath or welfare and/or to the environment. <br /> CLIENT RESPONSIBILITIES AND ASSUMPTIONS <br /> • Atherton Kirk Development will assist Kleinfelder in obtaining access to the site and owner <br /> authorization for the proposed sampling. <br /> • Adequate work space and access will be provided. Kleinfelder will attempt to advance soil <br /> borings and collect samples at the proposed locations. If the drilling equipment cannot be <br /> positioned, or unanticipated conditions (such as buried drums or other hazardous <br /> conditions) are encountered, alternative drilling locations or sampling methods should be <br /> investigated. <br /> • Because the borings are not anticipated to penetrate the ground surface, the borings will be <br /> closed by backfilling them with the lime pond cuttings. All equipment (including trucks <br /> and drill rigs) will be steam cleaned prior to leaving the site. The equipment will be steam <br /> cleaned on open ground adjacent to the lime ponds. The steam cleaning water will not be <br /> contained. <br /> • This proposal is based on the presumption that Atherton Kirk Development will clearly <br /> mark utilities and will provide any and all available survey maps or other data to determine <br /> the location of tanks, existing structures, underground utilities, and services. The client <br /> should be aware that penetrating the site's surface is inherently risky. It is impossible to <br /> determine with certainty the precise location of all structures which may be buried in the <br /> ground. Kleinfelder's fee is not adequate to compensate for both the performance of the <br /> services and the assumption of risk of damage to such structures. Disruption of utilities or <br /> damage to underground structures and repair will be the responsibility of the client. <br /> services rendered by Kleinfelder to repair them will be billed at cost. Underground Services <br /> Alert (USA) at 1-800-642-2444 provides a partial location service free of charge for major <br /> utility lines. Kleinfelder can make contact with USA for a site visit, if requested. <br /> SCHEDULE <br /> Kleinfelder could initiate our services within 3 to 5 working days of receiving written <br /> authorization to proceed. Our report will be submitted for client review within 10 working days <br /> of receiving analytical results. Verbal results will be provided upon our receipt of the analytical <br /> data.
