In accordance with applicable <br /> provisions of law, the Department has scheduled the site for <br /> cleanup action under the Hazardous Substance Cleanup Bond Act <br /> of 1984, H&SC Section 25300 et seg. <br /> The Department has made a determination that you are a respon- <br /> sible party with respect to hazardous waste at the site. This <br /> determination is based on information that you are or were an <br /> owner/operator, producer, storer, disposer, treater, or <br /> transporter of hazardous waste at the site. Responsible <br /> parties may challenge this determination, but only after the <br /> Department has formally determined the degree of financial <br /> responsibility of all responsible parties in a final remedial <br /> action plan issued pursuant to H&SC Section 25356. 1. <br /> Enclosed with this letter is a Remedial Action Order for the <br /> Acme-Stockton Galvanizing site issued pursuant to H&SC Section <br /> 25355. 5. The Department intends to issue this order which sets <br /> forth the requirements of the investigation and remediation <br /> process and a time schedule for compliance. Also enclosed is a <br /> draft Stipulation to the Remedial Action Order. <br /> The Stipulation is an agreement to comply with the Order and <br /> provide in advance the Department's estimated costs for review <br /> and oversight of your site remediation activities as provided <br /> by H&SC Section 25360. The State Budget Act of 1987/88 <br /> requires the Department to actively "seek full reimbursement <br /> for projected expenses associated with monitoring hazardous <br /> waste mitigation projects operated under an agreement with <br /> responsible parties prior to initiation of such activities" . <br /> Enclosed is a memorandum which details our estimated costs for <br /> a one year period. <br />
