1 4 . 3 The remedial actions set forth in this Order are necessary <br /> 2 to enjoin and abate a nuisance dangerous to health. <br /> 3 Respondents' failure to perform these remedial actions shall <br /> 4 result in the Department's commencing and maintaining all <br /> 5 proper and necessary actions or proceedings to abate this <br /> 6 public nuisance. <br /> 7 <br /> 8 V <br /> 9 ORDER <br /> 10 IT IS HEREBY ORDERED that the Respondents conduct the following <br /> 11 activities: <br /> 12 5. 1 REMEDIAL INVESTIGATION FEASIBILITY STUDY AND DRAFT <br /> 13 REMEDIAL ACTION PLAN <br /> 14 5. 1. 1 Workplan Submission <br /> 15 Within thirty (30) calendar days of the effective date of this <br /> 16 Order, Respondents shall submit to the Department for review <br /> 17 and approval a detailed Workplan and implementation schedule <br /> 18 which covers all the activities necessary to conduct a complete <br /> 19 Remedial Investigation, Feasibility Study and draft Remedial <br /> 20 Action Plan for the Site and any areas where there is a release <br /> 21 or threatened release of hazardous substances from the Site. <br /> 22 The elements of the Workplan should be based on the EPA's <br /> 23 "Guidance on Remedial Investigation under CERCLA" (June, 1985) <br /> 24 and "Guidance on Feasibility Studies under CERCLA" (June, <br /> 25 1985) , the Department's document "The California Site <br /> 26 Mitigation Decision Tree Manual" (May, 1986) , and EPA's <br /> 27 "Community Relations in Superfund A Handbook" (March, 1986) . <br /> COURT PAPER <br /> STATE.1 C.111....A <br /> STD. 113 ,REV. 8 721 <br /> -9- <br /> 85 34769 <br />
