The borings will be drilled using a hand auger. No investigation derived wastes
will be allowed to remain on the property; these will be immediately removed. RWQCB
approved the workplan in a letter dated June 8, 2009. Copies of the workplan, including
maps, and other pertinent correspondence are enclosed along with a right of entry
agreement application form and a check for$555.
In view of the limited potential for liability associated with this work which will involve
only hand equipment, will include a railroad flagman and will be completed in a few
hours, we are requesting that UPRR accept the existing coverage limits of our insurance
policies. For general liability, professional liability, automobile and workers
compensation, the limits are $1 million. We will also obtain the required Railroad
Protective Liability coverage through UPRR's program with Marsh.
G:\GROUNDZE\ANDRADE\UPRRAccess\ROECoverLetter.doc
