Thank you for the status updates. I'd like to discuss further with you if you get a chance, but
realize it gets tricky with the time difference. I'll be in training all day tomorrow. So I'll be able to check in and out of my
desk throughout the day, but don't have an exact time availability. I currently don't have any appointments yet for
Thursday or Friday, if that works better.
I was not able to locate any removal permits for your site. Perhaps they are still waiting to submit it?
During the time prior to actual tank removal, the tank is required to be maintained in full compliance with the laws and
regulations, including the CERS submittal requirements. Also, in order to complete a tank removal, a removal submittal
will need to be made in CERS. This cannot be done until the tank has been officially reported in CERS.
As of right now, the facility has zero accepted CERS submittals since the change of ownership. A complete, accurate
CERS submittal is required to be made within 30 days of the change of ownership (close of escrow) and is now
overdue. The CERS forms are also the official application for an underground storage tank operating permit. Since the
facility has not made an accepted CERS submittal, they have not yet applied for an operating permit. Operating an
underground storage tank without a permit is a Class I violation. The 2019 and 2020 Hazardous Materials Business Plan
(HMBP) submittals are also past due. The deadline for the 2020 submittal was January 15tH
If you need help with the CERS submittal, I can be available in person or by phone. I should be able to provide most of
the information needed for the tank forms and monitoring plans, and I can send you any of the blank forms you will
need for uploads (Monitoring Site Plan (map), Certification of Financial Responsibility, Owner/Operator Written
Agreement, Letter from the CFO, Statement of Designated Operator, Statement of Understanding and Compliance).
I look forward to speaking to you soon.
Thank you,
Stacy Rivera
Lead Sr.Registered Environmental Health Specialist
San Joaquin County Environmental Health Department
1868 E.Hazelton Ave.,Stockton,CA 95205
office(209)468-3440
fax(209)468-3433
1
