Hazelton Ave. <br /> Stockton, CA 95205 <br />;r <br /> Dear Mr. Baracco: <br /> RESPONSE TQ YOUR REQUEST FOR TE`C.HNICAL ASSISTANCE FOR THE TERRA <br /> GENESIS PROJECT <br /> \ r <br /> These are the Department's answers to the question posed in your <br /> March 2 , 1988 letter to DHS: <br /> Answer to Question 1 <br /> The sample material is classified as hazardous waste by the <br /> Department, any soil contaminated by mixing or spilling a <br /> hazardous substance on or with soil results in hazardous waste. <br /> This is not a matter of policy or interpretation; it is <br /> established by Section 66300 (a) (3) of Title 22 , California Code <br /> of Regulations (CCR) . <br /> Answer to Question 2 <br /> No, once the soil is contaminated with hazardous material at anv <br /> level , the soil is considered hazardous waste. <br /> Answer to Question 3 <br /> The Department has evidence to indicate that soil contaminated to <br /> a level greater than 1000 ppm of total petroleum hydrocarbons <br /> (TPH) may fail the ignitability crxiteria established in Article <br /> Title 22 of the CCR. As such these waste soils should <br /> generally be transported to a hazardous waste facility unless <br /> another adequate method of handling the material is proposed and <br /> approved by the responsible agency. Sites exhibiting lesser <br /> levels of contamination need to be reviewed on a case-by case <br /> basis by the responsible local agency or the Regional Water <br /> Quality Control Board for appropriate site mitigation activity. <br />
