On 20 March 2000, staff received a Hazardous Material Spill Report from the Governor's Office <br /> of Emergency Services. The Discharger confirmed that a sewer lift station pump system had <br /> failed, and they were having problems with repeated failures after repairs and testing due to <br /> malfunctioning float control systems. On 17 April 2000, the Discharger reported that the lift <br /> station that caused the previous spill had overflowed again. After several attempts at repair, the <br /> float switch system was replaced. <br /> 14. During the week of 31 July 2000, staff received verbal odor complaints from several concerned <br /> citizens living near the facility. Staff inspected the facility on 2 August 2000 and found the odor <br /> level to be moderate; but the Discharger informed staff that the odor problem had previously been <br /> severe for several days due to inability to treat slug loads of degradable organic waste from the <br /> Sun Garden-Gangi tomato processing facility. <br /> 15. An NOV was issued for this violation on 1 August 2000. The Discharger was required to submit <br /> the following reports: <br /> a. A weekly status report on odor control efforts made during the previous week and additional <br /> efforts planned for the next week. <br /> b. A report describing what enforcement measures the City would take against Sun Garden- <br /> Gangi, including ceasing the discharge, providing additional pre-treatment, and/or levying <br /> fines. <br /> c. An Emergency Action Plan that details steps to be taken by the City to eliminate the odor <br /> problem as soon as possible. <br /> d. A Pretreatment Program Assessment Report that presents an engineering assessment of the <br /> City's Pretreatment Ordinance and all industrial discharge permits with respect to the ability <br /> of the City's wastewater treatment plant to provide sufficient treatment of all permitted <br /> discharges. <br /> e. A technical report describing plant improvements that would be completed prior to the next <br /> vegetable processing season and proposed revisions to the City's pretreatment ordinance and <br /> all existing industrial discharge permits. <br /> 16. On 24 August 2000, the Discharger submitted an Emergency Action Plan for Odor control, which <br /> detailed the City's plans to enforce against Sun Garden-Gangi for each instance of non- <br /> compliance. <br /> 17. During a review of routine monitoring reports for the facility in August 2000, staff noticed that <br /> several of the Discharger's ponds had a pattern of intermittent freeboard violations between April <br /> and July 2000. On 28 August 2000, an NOV was issued to the Discharger for these violations. <br /> Staff expressed concern that the facility might not have sufficient disposal capacity to <br /> accommodate the upcoming rainy season. The Discharger stated that the freeboard violations <br /> were due to plugging of the percolation ponds, and that they planned to dry out and rip at least one <br /> of the larger percolation ponds after the tomato processing season was over.
