REVISED CLEANUP AND ABATEMENT ORDER NO.5-01-703 -9- <br /> CITY <br /> 9- <br /> CITY OF RIVERBANK WASTEWATER TREATMENT PLANT <br /> STANISLAUS COUNTY <br /> The City of Riverbank shall comply with the following requirements: <br /> 1. Effective immediately, the monthly average treatment plant influent flow shall not exceed 4.5 <br /> mgd as a 30-day average during the three-month tomato-processing season (approximately 1 July <br /> through 30 September each year) and 1.8 mgd as a 30-day average during the rest of the year. <br /> 2. By 30 September 2003,the Discharger shall complete permanent repair of the northern berm of <br /> the Summer Aeration Cell and Summer 1 Pond to provide adequate static and pseudo-static <br /> factors of safety and prevent piping in accordance with the recommendations of a California- <br /> registered Geotechnical Engineer. *By this date,the Discharger shall submit a technical report <br /> signed by the Geotechnical Engineer describing the recommended action, and the Discharger shall <br /> certify that those recommendations have been fully implemented. <br /> 3. At least 120 days before anticipated use of any new facilities such as ponds, the Discharger <br /> shall submit a Report of Waste Discharge to apply for revised Waste Discharge Requirements for <br /> the facility expansion. <br /> In addition to the above, the City of Riverbank shall comply with all applicable provisions of the <br /> California Water Code that are not specifically referred to in this Order. As required by the California <br /> Business and Professions Code Sections 6735, 7835, and 7835.1, all reports shall be prepared by, or <br /> under the supervision of, a registered professional engineer and signed by the registered professional. <br /> If, in the opinion of the Executive Officer, the City of Riverbank fails to comply with the provisions of <br /> this Order,the Executive Officer may refer this matter to the Attorney General for judicial enforcement <br /> or may issue a complaint for administrative civil liability. <br /> This Order is effective upon the date of signature. <br /> R <br /> THOMAS R.
