On 21 March 2001, staff performed an inspection of the ponds and found the <br /> freeboard levels to be in violation of the WDRs. In addition,the northern berm showed signs of seepage <br /> onto neighboring private land, and both the western and northern berms appeared to be vulnerable to <br /> catastrophic failure unless emergency measures are implemented. A copy of our inspection report is <br /> enclosed for your records. <br /> The conditions reported by the City of Riverbank and observed by staff are violations of Waste Discharge <br /> Requirements (WDRs) Order No. 94-100. Specifically, Discharge Prohibition A.2 prohibits bypass or <br /> overflow of partially treated waste and Discharge Specification B.7 requires that the Discharger maintain <br /> sufficient capacity to prevent bypass or overflow. <br /> It is essential that the City of Riverbank take all reasonable action necessary to prevent discharges to surface <br /> waters and uncontrolled spillage outside the designated disposal areas. As we discussed on 21 March 2001, <br /> we will issue a Cleanup and Abatement Order in the near future. We understand that the City of Riverbank <br /> has discontinued the Riverbank Army Ammunition Plant (RBAAP) treated groundwater discharge and is <br /> considering shutting down the Sun Garden-Gangi tomato cannery discharge this summer.
