APPLICATION - FLOOD VARIANCE <br /> SAN JOAQUIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT <br /> ¢ INDINGS <br /> The following findings of fact must be made by the County before a Variance can be grentod. Indicate what facts In the case of this <br /> application support each of the findings. <br /> Thorn Is good and sufficient cause for the Flood Variance. <br /> Replacing the gazebo after removing an existing gazebo, dock and debris is <br /> consistent with almost every property along the river. If the proposed gazebo is <br /> not allowed, this property would certainly be denied a privilege enjoyed by all <br /> the properties in the vicinity. <br /> Failure to grant the Flood Variance would result In exceptional hardship to the applicant <br /> Substantial costs have been incurred to obtain a building permit (temporarily <br /> revoked) and to construct approximately 90% of the gazebo. <br /> The Flood Variance will not result In increased flood heights,additional threats to public safety,extraordinary public expanse,create <br /> nuisances,cause fraud on or victimization of the public,or conflict with existing local laws or ordinances. <br /> The proposed gazebo is located within the 100 year flood plain, however, it will <br /> not impact the flood elevation (see attached Flood Control letter dated 7-23-93) . <br /> The gazebo is not in the floodway, therefore Section 9-1605.17(b) does not a221y. <br /> The Flood Variance is the minimum necessary,considering the flood hazard,to afford relief. <br /> Relocating this gazebo is not realisticly or economically feasible and its' <br /> proximity to the river is essential for the intended use. <br /> Granting of the Flood Variance will not constitute a grant of special privileges inconsistent with the limitations on similarly situated <br /> properties subject to the County's flood regulations. <br /> The reconstruction of the gazebo is a privilege enjoyed by all of the properties <br /> along the river including public lands owned by the City of Lodi. <br />
