("Investigator')and Steve Sawyer(the"Property Owner"). <br /> RECITALS <br /> A. The Property Owner owns certain real property located at 15400 Steinegal Road <br /> Escalon. California The"Property"). 4f A)' Z Z`Y I ZD 2- <br /> B. <br /> B. Investigator is conducting a subsurface investigation pursuant to the terms of an <br /> agreement entered into with Former Raymond Greer Construction. <br /> C. Investigator wishes to conduct environmental sampling and testing on the <br /> Property to assist in this investigation as directed by San Joaquin County <br /> Environmental Health Department. <br /> NOW THEREFORE, in consideration of the mutual convenants contained herein, it is hereby <br /> agreed as follows: <br /> 1. Grant of License. Subject to the terms and conditions of this Agreement, the <br /> Property Owner hereby grants Investigator a license to enter the Property for the <br /> limited purpose of observing the site and collecting environmental samples. <br /> Investigator may be accompanied in these activities by authorized representative <br /> of San Joaquin County Environmental Health Department. <br /> 2. Limitations on Use. <br /> a.) Prior to each entry onto the Property, Investigator shall provide forty-eight(48) <br /> hours notice to the Property Owner, arrange for access,and, if requested by the <br /> Property Owner,allow oversight of all on-site activities. <br /> b.) Investigator shall ensure that none of its activities on the Property unreasonably <br /> interferes with or delays any other activities which are being undertaken on the <br /> Property. <br /> 3. Term. The term of this Agreement shall commence on the date of execution of <br /> this Agreement and shall continue thereafter until Investigator has completed its <br /> investigation of possible groundwater contamination or until December 31 <br /> 2012,whichever is sooner; provided, however, that with the mutual consent of <br /> both parties this term may be extended as necessary to accommodate further <br /> investigation. <br /> 4. Agreement Not Admission By entering into this Agreement, neither the Property <br /> Owner or Investigator is admitting any responsibility for any contamination at the <br /> Property. This Agreement shall not be construed or interpreted as an admission <br /> or concession of liability on the part of either the Property Owner or Investigator. <br /> The wells will be destroyed in accordance with regulatory requirements following <br /> completion of the project. Liability associated with destruction of the groundwater <br /> monitoring wells installed on the Property rests with Investigator's client. <br />
