The Plan has not
been enacted because one private parcel owner has not granted access to his parcel (Cano).
Your consultant, Geocon, has requested that the EHD contact the property owner and help
obtain a signed access agreement.
The EHD has reevaluated the proposed locations of the borings in the Plan (membrane
interface probes - MIP) that were to be on the Cano property and has concluded that with the
relocation of some of the borings an access agreement would not be needed.
Five MIP borings were proposed to be on the Cano property in the approved Plan. By moving
these borings as little as five feet, to just off the Cano property, the enactment of the Plan will no
longer be delayed. Three of the borings could be moved onto the County right of way to the
south and the east of the Cano property. The last two borings could be moved to the private
parcel to the west where an access agreement has been obtained. The EHD feels that the data
obtained from the relocation of these borings would be as useful as any data that would have
been obtained from the Cano property. Please modify the Plan Figure 2 to show the relocation
of the five borings that will now surround the Cano property and contact the San Joaquin County
Public Works Department at (209) 468-3057 to start procedures to obtain the required
encroachment permit.
If you have any questions, please contact Michael Infurna, Senior Registered Environmental
Health Specialist, at (209)468-3454.
Sincerely
, o
Michael J.
