This contamination continugs today <br /> under the ownership of Mohamed&Huda Gubary. Therefore,the current and past property overs, <br /> Mohamed&Huda Gubary,Nagi &Halima Saleh-Ali, and Durhim Saleh-Ali are all considered <br /> responsible parties. <br /> Therefore,pursuant to Water Code Section 13267 which states in part: <br /> "(b)(1) In conducting an investigation specified in subdivision (a), the regional board may <br /> require any person who has discharged, discharges, or is suspected of discharging, or who proposes to <br /> discharge waste within its region...shall furnish, under penalty of perjury, technical or monitoring reports <br /> which the regional board requires. The burden, including costs, of these reports shall bear a reasonable <br /> relationship to the need for the report and the benefits to be obtainedfrom the reports." <br /> and in accordance with the information in this letter,Mohamed&Huda Gubary,Nagi &Halima Saleh- <br /> Ali, and Durhim Saleh-Ali are required to: <br /> 1. By 31 December 1999, submit a plan and schedule to supply the residence at <br /> 23565 South Santa Fe Road with'an alternate (potable)water supply. <br /> 2. By 31 December 1999,.submit the Monitoring Well Installation Report for monitor wells installed <br /> on 24 November 1999. <br /> 3. Complete Quarterly Ground Water Monitoring and Sampling of the four on-site monitoring <br /> wells and the three domestic wells by 31 December 1999, and provide a report of quarterly <br /> ground water monitoring and sampling activities and analytical results by 31 January 2000. <br /> All wells must be sampled and analyzed for total petroleum hydrocarbons (TPH)by EPA Method <br /> 8015M, and for benzene, toluene, ethyl benzene,xylenes, all oxygenates, 1,2-DCA, and EDB by <br /> EPA Method 8260B. Some laboratories can run a complete suite of petroleum constituents and fuel <br /> additives by EPA Method 8260B, thereby saving considerable cost. <br /> All work must be performed according to the enclosed Appendix A of the Tri-Regional <br /> Recommendations for Preliminary Investigation and Evaluation of Underground Storage Tank Sites, <br /> and permits required by State and Local agencies. You must submit all reports to the Regional Board <br /> and the San Joaquin County Public Health Services. <br /> Failure to submit the requested technical reports could lead to fines authorized by Section 13268 of the <br /> Water Code,which states: <br /> "(a) Any person failing or refusing to furnish technical or monitoring program reports as <br /> required by subdivision (b) of Section 13267...is guilty of a misdemeanor and may be liable civilly in <br /> accordance with subdivision (b). <br />
