Santa Fe Road, Riverbank <br /> Prior to 1991, underground tank sites that had certain operating or reporting <br /> deficiencies were not issued the "paper" permit but were allowed to operate <br /> while these areas of concerned were brought to acceptable levels. PHS- <br /> EHD considered sites that paid their fees in compliance and were allowed to <br /> operate. Back fees were owed from 1986 through 1989 and an office <br /> hearing was held on October 18, 1989. An agreement signed by Mr. Nagi <br /> S. Ali stated he would pay fees by December 18, 1989, have precision tests <br /> by November 18, 1989, tanks removed by January 18, 1990. Fees were not <br /> paid, precision tests not performed, and the tanks were not removed by the <br /> dates established. A DA case was recommended. When the precision tests <br /> submitted on January 22, 1990 indicated tanks #2 and #3 failed, Mr. Ali was <br /> notified by PHS-EHD that the product was to be removed form these tanks <br /> until the problem is corrected. A site inspection on June 25, 1990 verified <br /> that the tanks were empty and that they are not "illegally" abandoned and <br /> must be brought into compliance or removed under an approved PHS-EHD <br /> permit. On April 2, 1991 fees were paid and on April 9, 1991 a closure plan <br /> received. The tanks were removed on May 20, 1991. <br /> I hope this clears up any questions you have about "permits". <br /> 1 <br />
