I assume thatyou were comfortabclaimant was both the owner and operator of the tanks at the time of discovery of the release in 1991,that he was exempt from the financial responsibility requirement because the tanks were removed prior to the 12/31/93 compliance date and were not mp]acsd2ff, Ince th�claimant didn't certify the tanks were not replaced,do we know? When you accept a claim application thaVis not complete,please include some notes on how you satisfied yourself that the information requested was not necessary for your review and that the eligibility requirements have been met(see my scribble notes). 2. It appears that the claimant never permitted the tanks. Your letter of January 10, 1997 requested additional information including information regarding the permit issue. Your letter of February 11, 1997 accepted the claim but apparently without a response to your January 10, 1997 letter. On October 29, 1997,you advised the claimant that he never permitted the tanks and needed M request a waiver of the eligibility requirement if eligible for the waiver. I don't see any response from the claimant.
