Please find attached the referenced NOV/Transmittal letter. At the conclusion of the field inspection, I believed that there were no significant violations. Subsequently, in reviewing the information gathered, including photographs, I determined that NuStar was speculatively accumulating the Trans Mix materials, reportedly being managed as Excluded Recyclable Materials. Once I made that determination I contacted Mr. Smith to let him know that this was significant issue (see e-mail below). I also called Mr. Smith before sending him the report via e-mail to let him know it was coming. NuStar has 14 days from the date of receipt of the inspection report to make a Confidential Business Information (CBI) claim.
