From: Schofield,John
To: Backus,Garrett; Kristine Green
Subject: Nustar-NOV/Transmittal Letter
Date: Friday,April 3,2020 8:26:36 AM
Attachments: 2020027 NuStar Transmittal NOV Ltr Final KM sianed.pdf
Garrett/Kristine,
Hope all is well you and your families. Please find attached the referenced NOV/Transmittal letter.
At the conclusion of the field inspection, I believed that there were no significant violations.
Subsequently, in reviewing the information gathered, including photographs, I determined that
NuStar was speculatively accumulating the Trans Mix materials, reportedly being managed as
Excluded Recyclable Materials. Once I made that determination I contacted Mr. Smith to let him
know that this was significant issue (see e-mail below). I also called Mr. Smith before sending him
the report via e-mail to let him know it was coming.
NuStar has 14 days from the date of receipt of the inspection report to make a Confidential Business
Information (CBI) claim. If there is no CBI claim, EPA will share the inspection report with DTSC and
SJCEHD.
Take care and be safe,
John
**************************************
John Schofield
U.
