from which it was transferred to their facility located at 500 Ireland Drive in McCarran, <br /> Nevada for re-refining.] <br /> b. provide the facility name(s)and address(es)where non-red-dyed diesel trans mix is <br /> transferred from the Stockton,California facility to the receiving facility, and how is the non- <br /> red-dyed trans mix managed at the receiving facility(ies).For example,on April 20,2020, <br /> NuStar provided a weighmaster certificate,No. 1180 dated April 4,2018. The destination <br /> facility is identified as Shore Terminals,LLC(Shore Terminals),90 San Pablo Avenue, <br /> Crockett, CA 94525. What does Shore Terminals do with the non-red-dyed trans mix. <br /> [Shore receives this material as product and uses it as a component in their vapor recovery <br /> process. It is put into a tank where it acts as a media for adsorption.]—Note that Shore <br /> Terminals LLC is a NuStar facility. <br /> 4. On February 19,2020,Garrett Backus,San Joaquin County,Environmental Health Department <br /> provided NuStar with the requirements for a material such as trans mix to be classified as an excluded <br /> recyclable material. One of the requirements is that the generator of the excluded recyclable material <br /> must be able to demonstrate that the trans mix is being transferred to a petroleum refinery and made <br /> into a product(see California Health and Safety Code 25143.2(d)(2)(D)and 25144(a)(4)). If none of <br /> the facilities where NuStar ships its trans mix to are petroleum refineries,how is NuStar able to <br /> classify the trans mix as an excluded recyclable material(see Item 3 above)? [This material has been <br /> shipped to Golden Gate Petroleum as an ERM;they re-refine into viable product at their McCarran, <br /> NV facility. Shore Terminals LLC receives this material not as an ERM,but as product.] <br /> 5. Provide copies of NuStar Standard Operating Procedures(SOPs)the company had in place at the <br /> time of the CEI regarding the management of trans mix at the Stockton,California facility. [Please <br /> see attached copy of procedure NOP-STL-13 BP Pre-Load Draining.] <br /> 6. Referencing NuStar's April 20,2020 and April 24,2020 response to EPA's April 2,2020 NOV, <br /> NuStar provided a figure of 10,240 pounds(lbs)of trans mix that was on-site on April 3,2018. <br /> Additionally,NuStar provided a figure of 1,470(5 X 294)lbs of trans mix which represented the <br /> trans mix containers observed by EPA during the CEI. <br /> a. Please confirm that the 10,240 lbs represent non-red-dyed trans mix that was being stored in <br /> Tank 1501. [The 10,240 lbs represents 5 55-gallon drums of trans mix.] <br /> 7. NuStar stated in its April 24,2020 response to EPA's April 2,2020 NOV that additional trans mix was <br /> generated between March 12,2019 and March 31,2020 and shipped off-site on March 31,2020 as D001 <br /> and D018 hazardous waste(Manifest 014796289FLE). <br /> a. How much of the trans mix shipped off-site was red-dyed diesel trans mix? Please provide <br /> internal tracking documents that supports the amount of red-dyed diesel trans mix included in the <br /> March 31,2020 off-site shipment. [As provided in Question I.a.ii.,red-dye and non-red-dye <br /> trans mix is not segregated.] <br /> 8. Provide copies of internal tracking records of the amounts and disposition of red-dyed diesel trans mix <br /> generated by NuStar between January 1,2018 and February 18,2020. [Please see attached copies of Bills <br /> of Lading dated 04/04/2018 and 03/12/2019.1 <br /> III-1 <br />
