SAN J OAQU I N Environmental Health Department <br /> CC LJ N T Y------- <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> GENERAL TRAILERS INC 2150 E Fremont St, Stockton January 14, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> > CCR 66266.81(a)(4)(B)Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. <br /> OBSERVATION: Bills of lading for the recycling of lead acid batteries from January 2017 to January 2020 were not <br /> found on site. A pallet containing 12+spent battery cores was observed during the inspection. <br /> REGULATION GUIDANCE: (A)The generator shall use either the manifest or a bill of lading which fulfills the <br /> requirements of Title 13 CCR section 1161,to record the shipment of spent lead-acid storage batteries to a person <br /> who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. <br /> (B)The generator shall retain, at the generator's place of business for at least three years, a legible copy of each <br /> manifest or bill of lading which identifies spent lead-acid storage batteries shipped to a person who stores the <br /> batteries or who uses, reuses, recycles or reclaims the batteries or their components. <br /> CORRECTIVE ACTION: Provide copies of battery core bill of lading records and a corrective action statement to <br /> the San Joaquin County Environmental Health Department within 30 days. <br /> This is a repeat violation, Class II. <br /> 120 HSC 25404.1.2 Failed to submit a certification and written response within 30 days for minor violations. <br /> OBSERVATION:This facility was inspected on 1/15/2014 and the following minor violations were written: <br /> -No spill control or decontamination equipment <br /> -Failed to retain receipts for lead acid batteries <br /> The inspection report was delivered to this facility on 1/16/2014. A complete Return to Compliance Certification <br /> form was not received by the San Joaquin County Environmental Health Department(EHD)within 30 days of <br /> inspection report delivery. <br /> REGULATION GUIDANCE: (c)(1)A person who receives a notice to comply detailing a minor violation shall have <br /> not more than 30 days from the date of the notice to comply in which to correct any violation cited in the notice to <br /> comply.Within five working days of correcting the violation, the person cited or an authorized representative shall <br /> sign the notice to comply, certifying that any violation has been corrected, and return the notice to the San Joaquin <br /> County Environmental Health Department(EHD). <br /> (e) If a person who receives a notice to comply pursuant to subdivision (a)disagrees with one or more of the <br /> alleged violations listed on the notice to comply,the person shall provide the EHD a written notice of disagreement <br /> along with the returned signed notice to comply. If the person disagrees with all of the alleged violations, the written <br /> notice of disagreement shall be returned in lieu of the signed certification of correction within 30 days of the date of <br /> issuance of the notice to comply. <br /> CORRECTIVE ACTION: Please provide a corrective action statement to the EHD within 30 days. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by February 14, 2020. <br /> Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152).
