Box 795 <br /> Modesto, CA 95353-0795 Modesto, CA 95353-0795 <br /> POTENTIAL ENFORCEMENT FOR NON-SUBMITTAL OF TECHNICAL REPORTS <br /> On 11 February 1998, Regional Board staff(staff) inspected the Southwest Hide facility located three <br /> miles south of Manteca. The former ponds, processing facility, monitoring wells and storage area were <br /> surveyed during this inspection. In a letter to Southwest Hide dated 3 March 1998, staff requested a <br /> revised closure postclosure maintenance plan (CPCMP) for the Southwest Hide facility by 30 April <br /> 1998. In a letter to staff dated 16 April 1998, Southwest Hide requested additional time to prepare the <br /> CPCMP and proposed to submit the CPCMP by 30 June 1998. In a letter to staff dated 30 June 1998, <br /> Southwest Hide requested a second extension of the due date for the CPCMP of 30 August 1998. <br /> We believe this extension is unwarranted based on the information provided. The vast majority if not all <br /> the data needed for CPCMP had been collected by 11 February 1998, as discussed during the site <br /> inspection. Therefore, pursuant to Section 13267 of the Porter-Cologne Water Quality Control Act (Act) <br /> you are required to furnish under penalty of perjury the following technical report by 7 August 1998: <br /> • A revised closure postclosure maintenance plan for the Southwest Hide facility. <br /> Pursuant to Section 13268 of the Act any person failing or refusing to furnish technical or monitoring <br /> program reports as required may be civilly liable. Civil liability may be administratively imposed by the <br /> Regional Board in an amount which shall not exceed one thousand dollars ($1,000) for each day in <br /> which the violation occurs. <br /> Staff looks forward to working with you and your staff during this project.
