SAN J U A Q U I N Environmental Health Department <br /> COUNTY <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> LUBE GUYS LLC DBA MIDAS 1 1014 N ELDORADO ST, STOCKTON January 07, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection. The facility has been operating since November 2019. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the site since it opened for all hazardous waste <br /> including used oil, used antifreeze, and oily solids including paper oil filters. Provide these records and a corrective <br /> action statement to the EHD within 30 days. <br /> This is a Class II violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection. The facility has been operating since November 2019. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the site since it opened for all hazardous waste <br /> including used oil, used antifreeze, and oily solids including paper oil filters. Provide these records and a corrective <br /> action statement to the EHD within 30 days. <br /> This is a minor violation. <br /> 119 HSC 25404(e)(4) Failed to report program data in the California Environmental Reporting System (CERS). <br /> OBSERVATION: This business's hazardous waste and hazardous materials business plan activities have not been <br /> reported on the California Electronic Reporting System (CERS)website. The facilty opened around November 1, <br /> 2019, more than 30 days prior to today. <br /> REGULATION GUIDANCE: Each regulated business shall report program data electronically on the CERS <br /> website. <br /> CORRECTIVE ACTION: Immediately report your business activities including the hazardous waste program on the <br /> CERS website.
