The following is an itemized list of hazardous waste violations that have not been <br /> addressed for Zacky Farms as of April 03, 2020. <br /> Open violations from September 25, 2019 inspection <br /> Violation#601 -Stored hazardous waste onsite greater than 180 days. <br /> OBSERVATION: On the south side of the facility at the outside area, one hazardous waste tank contained enough <br /> used oil to reach 2 inches on a dip stick. The tank was missing the accumulation start date. According to Freddy <br /> Mancha, Site Manager, all of the used oil should had been picked up. <br /> REGULATION GUIDANCE: <br /> A generator of less than 1,000 kilograms of hazardous waste in any calendar month who accumulates hazardous <br /> waste onsite for 180 days or less, or 270 days or less if the generator transports the generator's own waste, or <br /> offers the generator's waste for transportation, over a distance of 200 miles or more,for offsite treatment, storage, <br /> or disposal, is not a storage facility if all of the following apply: <br /> (1)The quantity of hazardous waste accumulated onsite never exceeds 6,000 kilograms. <br /> (2)The generator complies with the requirements of 40 Code of Federal Regulations section 262.34(d), (e)and (f). <br /> (3)The generator does not hold acutely hazardous waste or extremely hazardous waste in an amount greater than <br /> one kilogram for more than 90 days. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 180 days in <br /> compliance with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the <br /> disposal records to the San Joaquin County Environmental Health Department(EHD)within 30 days. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#704-UW handler failed to properly manage universal waste lamps. <br /> OBSERVATION: The facility is managing universal waste(UW)lamps in a way that does not prevent a release of <br /> waste to the environment. In the east attic area, several used UW lamps were observed stacked on each other and <br /> not placed in a box. Several dozen used UW lamps were also sticking out of their box. <br /> REGULATION GUIDANCE: <br /> (b)Lamps(including M003 wastes that contain lamps).A universal waste handler shall manage lamps in a way that <br /> prevents releases of any universal waste or component of a universal waste to the environment, as follows: <br /> (1)A universal waste handler shall contain any lamp in a container or package that is structurally sound, adequate <br /> to prevent breakage, and compatible with the contents of the lamp. Such a container or package shall remain <br /> closed and shall lack evidence of leakage, spillage or damage that could cause leakage under reasonably <br /> foreseeable conditions. <br /> (2)A universal waste handler shall immediately clean up and place in a container any lamp that is broken and shall <br /> place in a container any lamp that shows evidence of leakage or damage that could cause the release of mercury or <br /> other hazardous constituents to the environment. Containers shall be closed, structurally sound, compatible with the <br /> contents of the lamps and shall lack evidence of leakage, spillage, or damage that could cause leakage or releases <br /> of mercury or other hazardous constituents to the environment under reasonably foreseeable conditions. <br /> (3)A universal waste handler may remove a lamp from a product or structure, provided the universal waste handler <br /> removes the lamp in a manner designed to prevent breakage. <br /> CORRECTIVE ACTION: Immediately place all UW lamps into closed, structurally sound containers with labeling: <br /> "universal waste-lamps". Provide a corrective action statement and supporting documentation to the San Joaquin <br /> County Environmental Health Department(EHD)within 30 days. <br /> Page 7 of 14 <br />
