STOCKTON January 13, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection.Copies of disposal records were not found during the inspection for 2018 hazardous <br /> waste streams including used oil,oil filters(paper and metal), oily absorbent, parts washer waste, and used <br /> antifreeze. Copies of disposal records were not found during the inspection for 2017 hazardous waste streams <br /> including oily absorbent and parts washer waste. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste.This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: Provide a copy of the missing disposal records for the dates and waste streams listed <br /> above. Provide these records and a corrective action statement to the EHD within 30 days. <br /> This is a repeat violation, Class II. <br /> 113 HSC 25160.2(b)(3)Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Copies of consolidated manifest receipts were not found during the inspection for 2018 hazardous <br /> waste streams including used oil,oil filters(paper and metal), oily absorbent, parts washer waste, and used <br /> antifreeze. Copies of consolidated manifest receipts generated in 2017 hazardous waste streams including oily <br /> absorbent and parts washer waste were not found during the inspection. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all missing consolidated manifest receipts listed above and <br /> maintain them on site.
