The following is an itemized list of hazardous waste violations that have not been <br /> addressed for JIFFY LUBE #2322 as of May 28, 2020. <br /> Open violations from December 12, 2019 inspection <br /> Violation#512 -Failure to obtain a reassessment of a tank system within 5 years or as required. <br /> OBSERVATION This facility has hazardous waste tanks which have not been reassessed by a Professional <br /> Engineer within the past five years. The tank assessment on the 1000 gallon used oil tank was last done January <br /> 2014. <br /> REGULATION GUIDANCE: <br /> The assessment specified in subsection (k) of this section shall be obtained prior to placing a new tank system in <br /> service and shall be kept on file at the facility. This assessment shall be reviewed and certified by an independent, <br /> qualified, professional engineer, registered in California, in accordance with section 66270.11(d), attesting that the <br /> tank system has sufficient structural integrity and is acceptable for the transferring, storing and treating of hazardous <br /> waste. The assessment shall be valid for a maximum period of five (5)years or the remaining service life of the tank <br /> system, as stated in the engineer's assessment, whichever is less. <br /> CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin <br /> County Environmental Health Department(EHD)within 30 days. Provide a complete copy of the tank assessment <br /> document, when available. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#601 -Stored hazardous waste on site longer than 90 days without a permit or authorization. <br /> OBSERVATION The following hazardous waste containers were found on-site with an accumulation start date of <br /> greater than 90 days or no accumulation start date: <br /> -Two 55 gallon drums containing oily solids were observed with no accumulation start dates. <br /> -One 55 gallon drum of hazardous waste in the Northeast corner of the hazardous waste storage was observed <br /> with no accumulation start date. <br /> -One 55 gallon drum containing paper oil filters was lacking hazardous waste label and accumulation start date. <br /> REGULATION GUIDANCE: <br /> (a) a generator may accumulate hazardous waste on-site for 90 days or less <br /> (b)The beginning of the 90 day period is determined as follows: <br /> (1) if the generator does not generate more than 100 kilograms of hazardous waste or one kilogram of acutely <br /> hazardous waste (listed in section 66261.33(e))or one kilogram of extremely hazardous waste during any calendar <br /> month, the 90 day period begins on the date the generator has accumulated 100 kilograms of hazardous waste or <br /> one kilogram of acutely hazardous waste or one kilogram of extremely hazardous waste; <br /> (2) if the generator generates more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous <br /> waste or one kilogram of extremely hazardous waste during any calendar month, the 90-day period begins on the <br /> first date on which any amount of hazardous waste begins to accumulate during that month. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 90 days in <br /> compliance with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the <br /> disposal records to the San Joaquin County Environmental Health Department(EHD)within 30 days. <br /> Page 1 of 2 <br />
