School, Lodi, <br /> CA 94240 site is not eligible for reimbursement in the Underground Storage <br /> Tank Cleanup Fund. Therefore, it is being proposed that your claim be <br /> removed from the priority list based on the following reason(s) : <br /> The UST Cleanup Fund regulations require that in order to be eligible <br /> for reimbursement a claimant must be in compliance with corrective <br /> action directives. You failed to comply with San Joaquin County <br /> Environmental Health directives to implement groundwater <br /> investigation. Although you claim to have done extensive soil <br /> excavation on your site, you never submitted evidence of excavation or <br /> hazardous waste manifests to show proper disposal of contaminated <br /> soil. Also, you did not submit requested laboratory results and <br /> workplan proposals for ground water monitoring. (California Code of <br /> Regulations,Title 23 , Division 3 , Chapter 18 , Section 2811 (a) (4) & <br /> (5) • ) <br /> This letter is considered a Final Staff Decision. If you are not in <br /> agreement with this decision, you may request review of the decision by the <br /> Chief of the Division within sixty (60) calendar days of receipt of this <br /> letter as provided in Article 5 of the Cleanup Fund Regulations. Please <br /> send any request for review to: Mr. Harry M. Schueller, Division Chief, <br /> SWRCB, Division of Clean Water Programs, P. O.
