School Street SIZE CODE: 1371 <br /> Lodi, CA 95240 <br /> This letter from San Joaquin County Public Health Services,Environmental Health Division (PHS/EHD) <br /> is in response to a written request (copy of letter enclosed) from Attorney Ronald M. Beckman regarding <br /> the above site. <br /> Soil contamination was confirmed at this site when five underground storage tanks were removed from <br /> the site in September 1987. Further site investigation is warranted to show that groundwater has not <br /> and will not be impacted from the release of petroleum hydrocarbons that were stored in the <br /> underground tanks. The responsible parties for this site have not conducted the investigation required <br /> by"California Code of Regulations Title 23 Division 3 Chapter 16, Sections 2652 and 2653". <br /> On August 8, 1991 PHS/EHD requested that the Central Valley Regional Water Quality Control Board <br /> (CVRWQCB) consider formal enforcement action since the responsible parties had not responded to our <br /> requests for further site investigation. <br /> On September 30, 1991 CVRWQCB required the responsible parties submit a report to outline further <br /> site work by October 30, 1991. Due to the fact that a report has not been submitted, CVRWQCB may <br /> initiate formal enforcement action at any time. <br /> From the time PHS/EHD was originally contacted regarding placement of a day care center at this site, <br /> our position has remained the same. PHS/EHD does not have any regulations governing the <br /> construction or operation of day care centers; however, it is the position of PHS/EHD that further <br /> investigation and remediation of this site will be required. Even though the present above ground <br /> conditions at the site may not pose a threat or risk to the health of individuals on the premises, the <br /> equipment required to perform further subsurface investigation and the odors, dust and noise generated <br /> from these activities may pose a threat or risk to individuals in proximity of the work Therefore any <br /> business proposing to operate at this site must take into consideration the potential disruptions and <br /> hazards that may occur. <br /> A Division of San Joaquin Counry Health fare Semmes �� <br />
