r-
`ow, N"00.1
2) With regard to the site name, it is referred to as the
"Newfield Property" in our records because the property was
identified by that name at the time of tank removal. When a
property is vacant, the file name is not generally changed.
3) We also discussed your desire to apply for UST cleanup funds
through the SB 2004 program. I referred you to the State
Water Resources Control Board "UST Cleanup Fund Program" to
obtain clarification about the requirement that applicants be
in compliance with all local agency directives.
4) The issue of the formal enforcement action which has been
requested from the Central Valley Regional Water Quality
Control Board (CVRWQCB) was discussed in length. It was noted
that the other responsible parties, identified by your letter
received on 5 October 1990 and documented by title research
performed by our staff, have received the same directives. In
summary, I suggested that you submit documentation to support
your contention that you are unable to perform the required
site assessment investigation because of financial insolvency
or other lack of financial resources. It may be beneficial
for you to work jointly with the other responsible parties in
order to proceed with the investigation and cleanup of this
site. Once again, I recommend that you respond to the CVRWQCB
letter of 30 September 1991, with either the required report
or an explanation of your intentions regarding this site,
prior to the compliance date of 30 October 1991.
5) As we also discussed, formal enforcement action is currently
being pursued on this site due to the failure of the
identified responsible parties, including yourself, to provide
information necessary to show that groundwater under this site
has not been contaminated and that there is not a significant
threat to nearby City of Lodi wells.
Please contact Margaret Lagorio of my staff at 468-3449, or myself,
if you have further questions regarding this matter.
Jogi Khan a, M.D. , M.P.H.
Health f icer
u.GiLtrP
Cotulla, R.E.H.S.
( Prau
ogram Manager
enc:
