PROPERTY, 107 NORTH SCHOOL STREET, LODI, SAN JOAQUIN COUNTY <br /> You have all been identified by San Joaquin County Public Health Services as <br /> Responsible Parties for the underground tank site at 107 Horth School Street <br /> in Lodi. In a letter dated 8 August 1991, Ms. Laurie Cotulla, of San Joaquin <br /> County Public Health Services, Environmental Health Division, requested the <br /> Board consider formal enforcement action regarding the site. We have reviewed <br /> our file and found that soil contamination and possible ground water <br /> contamination exist on site. Soil contamination was found during tank removal <br /> in September 1987. County staff have repeatedly requested additional <br /> investigation to determine the extent of contamination, but the extent of <br /> contamination remains undefined. <br /> By 30 October 1991, you are to submit a Preliminary Investigation and <br /> Evaluation Report as described in the Tri-Regional Recommendations and <br /> Appendix A (attached) . Regional Board authority to require this report is <br /> found in Section 13267 of the California Water Code which states, in part: <br /> (b) .. . the regional board may require that any person discharging or <br /> proposing to discharge waste within its region or any citizen or <br /> domiciliary, or political agency or entity of this state discharging or <br /> proposing to discharge waste outside of its region that could affect the <br /> quality of waters within its region shall furnish, under penalty of <br /> perjury, those technical or monitoring program reports as the board may <br /> specify. The burden, including costs, of these reports shall bear a <br /> reasonable relationship to the need for the reports and the benefits to <br /> obtained from the reports. -- <br /> Note also Section 13268: <br /> (a) Any person failing or refusing to furnish technical or monitoring <br /> program reports as required by subdivision (b) of Section 13267, or <br /> falsifying any information provided therein, is guilty of a misdemeanor <br /> and may be liable civilly in accordance with subdivision (b). <br /> (b)(1) Civil liability may be administratively imposed by a regional <br /> board in accordance with Article 2.5 (commencing with Section 13323) of <br /> Chapter 5 [of the Water Code] for violation of subdivision (a) in an <br /> amount which shall not exceed one thousand dollars ($1,000) for each day <br /> in which the violation occurs. <br />
