~/
February S, 1988
8 E /\ L E S l[ A T E , | W C '
Patrick Johnston
Assemblyman, 26th District
31 E. Channel
Stockton, CA 95201
Sir:
I d0 writing this letter with the hope that somebody might d0 \
something to remedy what I consider an dtrUSitV in legislation and, without
question, irresponsible government.
About 4 years ago Assembly Bill 88-1362 passed and could put iia-'
slf
and hundreds or even thousands of people like Ne in the poorhouse! That
bill says that any owner /D0t user) of underground gas tanks that have
leaked is responsible for the clean up, regardless Of who put the gas in
these tanks in the first place.

I purchased my property in 1979 when gas tanks were an asset. I \`
never sold d gallon of gas to anybody and never used the tanks for anything. ^
Unfortunately, I did not remove them. Recently, because of threats of
( `~
fines, etc. , l removed these tanks only to find that they were riveted
together, which t d in the l93O/ when they were placed in the og er, was up w c co ( ` .
ground which was mandated by the City of Lodi at the time. . / \ `y
I have spent close to $20,000 to date, and the Health Dppd/t|o20t
,has asked me to place monitoring wells in the ground at d Cost Of another
$20,000! These wells will indicate that the water table has hceO Contamina-
ted, and then the County wants N8 to sink $40,000 worth of additional wells
that will probably tell us that d clean-up operation that cuuld cost in the
millions, is needed.
I have not gotten d Q0Od Dight sleep since l spent the last $20,000,
and now they expect me to spend another $20,000!
'
I dm being treated like a criminal by the Health Department and see
.no end in sight.
IS THERE ANYBODY OUT THERE LISTENING? y
HELP! !
lit
"
)/oseph K.
