World Wide Web http://www.swrcb.ca. gov/-cwphome/ Since your letter noted the site is a strategic part of an extensive redevelopment and fundhome.htm revitalization project in downtown Lodi, Ron Markle of my staff took the liberty of discussing the issue directly with Mr. Konradt Bartlam, City of Lodi's Director of Community Development. I will respond to your questions and to several questions asked by Mr. Bartlam. 1. Is the current owner of the property eligible to re-apply, what is the procedure he should follow and what will the re-evaluation process involve? The current property owner's claim filed in 1992 was denied funding for having ignored both County and Regional Water Resources Control Board cleanup directives and for being consistently uncooperative in working with the regulatory agencies. The program can help those who are eligible and comply with requirements. One of the eligibility requirements is to be and have been in compliance with directives from the regulatory agencies. The claimant appealed the denial to the Division Chief and filed a petition with the State Water Resources Control Board (SWRCB). The SWRCB declined to review the petition. Program regulations allow a claimant to resubmit a claim that has been removed from the Priority List after elimination of the grounds which gave rise to the removal. The property owner can re-apply if he is now in compliance with directives from the regulatory agency and his eligibility will be re-evaluated. Whether the claimant has commenced corrective action or otherwise has taken steps that are reasonable and acceptable to the enforcing agencies will be an essential question.
