School Street, Lodi, re-applying for reimbursement of corrective <br /> FAX(916)227-4530 <br /> action costs. <br /> World Wide Web <br /> http://www.swrcb.ca. <br /> gov/-cwphome/ Since your letter noted the site is a strategic part of an extensive redevelopment and <br /> fundhome.htm revitalization project in downtown Lodi, Ron Markle of my staff took the liberty of <br /> discussing the issue directly with Mr. Konradt Bartlam, City of Lodi's Director of <br /> Community Development. <br /> I will respond to your questions and to several questions asked by Mr. Bartlam. <br /> 1. Is the current owner of the property eligible to re-apply, what is the procedure he <br /> should follow and what will the re-evaluation process involve? <br /> The current property owner's claim filed in 1992 was denied funding for having <br /> ignored both County and Regional Water Resources Control Board cleanup <br /> directives and for being consistently uncooperative in working with the regulatory <br /> agencies. The program can help those who are eligible and comply with <br /> requirements. One of the eligibility requirements is to be and have been in <br /> compliance with directives from the regulatory agencies. The claimant appealed <br /> the denial to the Division Chief and filed a petition with the State Water Resources <br /> Control Board (SWRCB). The SWRCB declined to review the petition. <br /> Program regulations allow a claimant to resubmit a claim that has been removed <br /> from the Priority List after elimination of the grounds which gave rise to the <br /> removal. The property owner can re-apply if he is now in compliance with <br /> directives from the regulatory agency and his eligibility will be re-evaluated. <br /> Whether the claimant has commenced corrective action or otherwise has taken <br /> steps that are reasonable and acceptable to the enforcing agencies will be an <br /> essential question.
