Such arrangements must be in writing and prior to the work.. The <br /> current property owner is still the claimant and is only claiming costs that he has <br /> I <br /> paid. <br /> 5. Can the City assistthe current propertyowner with the required corrective <br /> Yes. The Fund has permitted third-parties to advance money to eligible claimants <br /> for cleanup where there was an express written agreement in place before costs are <br /> incurred, where the agreement has merit and not a means to circumvent eligibility <br /> or priority requirements, and where the agreement requires the claimant to pursue <br /> his claim with the Fund and to the degree reimbursed, repay the money advanced. <br /> 6. What steps should a third party undertaking corrective action "on behalf of the <br /> current property owner take to maximize reimbursements from the Fund should a claim <br /> be accepted? <br /> First, work closely with the regulatory agency on what is required to remediate the <br /> site.
