Soil <br /> contamination was evidenced. Referrals were made to the San Joaquin County District attorney requesting <br /> legal actions for falsifying information. There was some over-excavation of evidenced soil contamination, but <br /> the results were questionable since B.Frahm habitually applied the compound,Simple Green, a practice for <br /> which he was ultimately prosecuted. A potential property owner performed a site assessment, drilling four <br /> borings in the areas of the former tanks, evidencing significant soil contamination which warranted a <br /> groundwater investigation. Subsequently,a limited groundwater investigation was performed which <br /> evidenced groundwater contamination up to 20 ppm benzene. Groundwater was encountered at 55.5 feet <br /> below ground surface and approximately 0.25 inches of floating product-was observed. Once groundwater <br /> contamination was evidenced the potential property owner directed that all investigation cease. Since April 6, <br /> 1993, there has been no further investigation. <br /> The nearest municipal well is identified as the Station 30 Well - 30-01 which was installed June 27, 1952. The <br /> total depth of this well is 516 feet, it is perforated between 288 feet and 516 feet and is conductor cased from <br /> ground surface to 288 feet,with a 12 foot cement seal installed. <br /> Resoonsible Parry's Compliance Description <br /> The responsible parry has demonstrated a flagrant disregard for the law. He plead guilty to violations of <br /> Health and Safety Code and Business and Professions Code occurring at the above referenced site as well as <br /> others throughout San Joaquin County. He was ordered to pay a $50,000 fine on December 8, 1992. He also <br /> was convicted of another crime in December 1990, served a 60-day jail sentence and was ordered to pay <br /> 170,000, $100,000 of which to be paid by he and his former wife's homeowner's insurance. <br /> In 1991, Brad Frahm initiated bankruptcy proceedings which were completed as a Chapter 7 bankruptcy on <br /> February 3, 1993. <br /> Dispute Documentation <br /> There have been no formal disputes between the responsible parry and this regulatory agency. <br /> Description'of the Proposed Cleanup and/or Abatement <br /> The initial scope of work would include a soil and groundwater investigation to assess the remaining soil <br /> contamination and to determine the extent of the groundwater contamination plume. Once the soil and <br /> groundwater contamination has been delineated and risk determined, soil and/or groundwater remedial <br /> alternatives will be considered for implementation. <br /> Funding Reguested <br /> S 100,000 per year will be requested initially to ensure that there,will be adequate funds to perform the <br /> necessary environmental investigation to define the extent of the contamination and thereby have information <br /> regarding the risk that the site poses. It is estimated, based on average site costs, that the total costs to <br /> achieve site certification will not exceed $300,000. <br />
