VISITOR/VENDOR RELEASE AND CONFIDENTIALITY AGREEMENT
<br /> 1 . Release . For good and valuable consideration , the receipt and sufficiency of which is
<br /> hereby acknowledged , including , but not limited to , being granted access to the Company' s
<br /> premises , the undersigned , for themselves and on behalf of their employees and agents ,
<br /> hereby voluntarily release , discharge , waive and relinquish any and all claims , demands ,
<br /> actions and causes of action whatsoever which the undersigned or their employees or
<br /> agents now has or in the future may have , against Ardent Mills or its subsidiaries and
<br /> affiliates ( collectively , the " Company" ) , or any of its officers , agents , directors or employees ,
<br /> whether known or unknown , suspected or unsuspected , and whether the same be now
<br /> anticipated or unanticipated , resulting from personal injury , death or property damage
<br /> sustained by the undersigned or their employees or agents while on the Company' s
<br /> premises . The undersigned further agrees for themselves , and on behalf of their
<br /> employees and agents that they shall not commence or maintain any suit against the
<br /> Company , its officers , agents , directors or employees relating to any such claim . This
<br /> Release shall be binding upon the undersigned , their employees and agents together with
<br /> each of their successors , assigns , executors , administrators , personal representatives and
<br /> heirs .
<br /> 2 . Medical Screening . Where there is a risk to product safety , visitors , contractors and
<br /> temporary labor agree that they are feeling well , are not suffering from a communicable
<br /> disease , do not have any open wounds , sores , or cuts and do not have any symptoms of
<br /> an illness such as vomiting or diarrhea . If you are unable to agree to these statements BY
<br /> SIGNING THIS AGREEMENT , your entry into raw material , preparation , processing , and
<br /> packing and storage areas to this facility may need to be rescheduled or additional
<br /> precautions may be taken .
<br /> 3 . Confidentiality . The undersigned , for themselves and on behalf of their employees and
<br /> agents , agrees to keep any and all information disclosed to them while on the Company' s
<br /> premises ( either in writing , orally or otherwise ) confidential , and shall not disclose such
<br /> information to any third party for any purpose whatsoever .
<br /> 4 . Validity of Other Agreements . This Release and Confidentiality Agreement shall not be
<br /> construed or otherwise interpreted as superceding any other agreement which is binding
<br /> on the undersigned , or their employees or agents .
<br /> 5 . Acknowledgment. The undersigned acknowledges that they have carefully read this
<br /> Release and Confidentiality Agreement , they understand they have given up substantial
<br /> rights by signing it , and they have signed it voluntarily . The undersigned also
<br /> acknowledges that they have read and will comply with all Safety Rules and Good
<br /> Manufacturing Practices posted during their visit .
