Box 944212 <br /> Sacramento, CA 94244-2120 <br /> Subject: Appeal of Denied Pre-approval for Proposed Work at Former Thiemann's Service <br /> Station, CSTCF Claim No. 001978 <br /> Dear Mr. Schueller: <br /> Smith Technology Corporation, on behalf of Mr. Gerald Thiemann, is appealing the denial of pre- <br /> approval for the proposed work at the Former Thiemann's Service located at 106 West Second <br /> Street in Ripon, California. The pre-approval was denied by Mr. Ismael Jacobo in his letter dated <br /> July 31, 1996. <br /> , <br /> Attached please find the following documents: <br /> A. A copy of the originalpre-approval package submitted to Mr. George Lockwood who <br /> since has been replaced by Mr. Ismael Jacobo. The package includes our workplan, a <br /> copy of the meeting minutes and correspondence with the local oversight agency <br /> requesting the work, and our proposal. <br /> i <br /> B. A letter from Mr. Ismael Jacob denying pre-approval of the proposed scope of work. The l <br /> letter suggests the scope of work should be quarterly monitoring done with the approval <br /> of the local oversight agency. However, the local oversight agency requests the scope of <br /> work described in the original pre-approval package be completed. 1 <br /> I <br /> C. A copy of the most recent quarterly monitoring report which includes all historical data. <br /> } <br /> This appeal is being submitted due to the fact that our client is required by the San Joaquin <br /> County Public Health Services Environmental Health Division (PHS/EHD) to complete the scope <br /> of work outlined in our workplan. PHS/EHD is requiring the scope of work to remediate <br /> impacted soil beneath the site which in turn has impacted groundwater. Our workplan to <br /> complete this task was approved by PHS/EHD on June 20, 1996.
