The facility provides cleanup <br /> materials, but they do not accept the waste once it has been contaminated. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately cease this practice and make a hazardous waste determination for each <br /> waste. Manage any waste generated according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling <br /> and test results or other knowledge to support your hazardous waste determination. Waste testing must be done <br /> using methods specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. <br /> This is a Class II violation. <br /> 104 CCR 66262.34(d)(2)No modified contingency plan. <br /> OBSERVATION: A complete modified contingency plan was not posted at the facility. The modified contingency <br /> plan was missing the emergency coordinator information. <br /> REGULATION GUIDANCE: The business operator must post the following information next to telephones or in <br /> areas directly involved in the generation and accumulation of hazardous waste: the name and emergency <br /> telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the <br /> telephone number of the fire department unless the facility has a direct alarm. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by Brad Stermer, Harbormaster, <br /> correcting the plan.
