The following is an itemized list of hazardous waste violations that have not been <br /> addressed for J M EQUIPMENT COMPANY INC as of March 19, 2020. <br /> Open violations from January 22, 2020 inspection <br /> Violation#114-Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: The following designated facility signed copies of Uniform Hazardous Waste Manifest(UHWM) <br /> numbers were not found on-site: <br /> 2019: <br /> -0062420217GBF (9-4-19) <br /> 2018: <br /> -003639474GBF(2-9-18) <br /> -006045944GBF(Absorbent) <br /> -006045593GBF(8-15-18) <br /> -003732825GBF(Absorbent) <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. The hazardous waste generator must submit an exception report to <br /> the California Department of Toxic Substances Control (DTSC)within 45 days if the destination facility signed <br /> manifest copy is not received from the transporter or designated facility. <br /> CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San <br /> Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be <br /> found then prepare an exception report for each missing manifest as required by Title 22 California Code of <br /> Regulations section 66262.42. Send a copy of the exception report to DTSC and the EHD. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#301 -Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: The following were observed in the hazardous waste storage area near the forklift washing area: <br /> -Two 55 gallon drums with waste solids(oily sludge)observed with sludge accumulating on drum and on the asphalt <br /> ground. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean sludge from drums and asphalt. Manage the waste according to Title <br /> 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the <br /> San Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned <br /> up waste. <br /> Page 1 of 6 <br />
