INFORMATION SHEET <br />J.R. SIMPLOT COMPANY <br />LATHROP, SAN JOAQUIN COUNTY <br />As of 1 January 1983, Occidental Chemical Agricultural Products, Inc. (OCAP, for- <br />merly Occidental Chemical Company) conveyed to the J.R. Simplot Company (Simplot) <br />certain property and assets of the agricultural chemical production facility <br />located at 16777 South Howland Road, one mile south of Lathrop in San Joaquin <br />County, Section 35, T1S, R6E, MDB&M. Not included in the conveyance, but retained <br />by OLAP, were the ground water remedial system, its supporting laboratory, records, <br />and equipment, the phosphoric acid production plant, and the aqua recovery system. <br />Under terms of the Stipulation and Judgment Approving Settlement (No. CIV S-79-989 <br />MLS, hereafter Stipulation) entered as of 3 April 1981 in the civil action between <br />the United States of America and the State of California versus Occidental Chemical <br />Company, OCAP must permanently refrain from storing in any pond or tanks any <br />hazardous liquid or solid wastes for time periods as specified; OCAP is prohibited <br />from discharging pesticides or other chemicals, process wastewaters, and contamin- <br />ated runoff; and OCAP must assure that any disposal site selected to receive its <br />hazardous wastes is authorized, safe, and lawful. <br />Under terms of the Stipulation and Order (hereafter Order) approved by the Court <br />21 December 1982, California consented to the transfer from OCAP to Simplot of the <br />Lathrop property and assets provided that OCAP expressly retains full responsi- <br />bility for compliance with all obligations imposed by the Stipulation, and that <br />Simplot assumes responsibility for the proper handling, storage, and disposal of <br />liquid and solid wastes and stormwater runoff in accordance with the Stipulation. <br />J.R. Simplot Company manufactures fertilizers and related chemicals and formulates <br />(blending concentrated technical grade pesticides with inert ingredients) 150 to <br />200 different pesticides. Principal waste streams include: <br />1. Nonprocess waters and rainwater runoff from the nonprocess area discharged <br />to an unlined pond <br />2. Rainwater runoff from the ferilizer manufacturing area discharged to two <br />hypalon-lined ponds <br />3. Process waters from the fertilizer manufacturing area discharged to an <br />asphalt lined holding basin for recycling in pellet manufacturing <br />4. Irrigation waters from the unlined and hypalon-lined ponds discharged to <br />agricultural lands <br />5. Demineralizer backwash water from a zeolite water softener discharged to <br />the unlined ponds. <br />6. Rainwater runoff and equipment rinsate from the Agricultural Chemical <br />Department discharged to storage tanks for transport to a Class I landfill <br />for disposal. <br />TRP:dg <br />Amended 3/25/83 <br />
